Who we are
Evolka is operated by Furthersoft Limited, a company registered in England and Wales (company number 14886010), registered office 71-75 Shelton Street, London, WC2H 9JQ, United Kingdom. “We”, “us” and “our” mean Furthersoft Limited. Contact: info@evolka.app.
By creating an account you accept these terms. How we handle personal information is explained in the privacy policy, which is a separate document. You do not consent to it by accepting these terms.
Who can use Evolka
You must be 16 or older. One account is for one person. Keep access to your sign-in method (Sign in with Apple, Google, or the email address that receives your sign-in code) secure. Tell us at info@evolka.app if you think someone else has used your account.
Not medical advice
Evolka is a fitness coaching app. It does not diagnose, treat or prevent any illness, and it is not a substitute for a doctor or physiotherapist.
Talk to a qualified professional before you start training if you are pregnant, have a heart, lung or joint condition, take medication that affects exercise, or are recovering from an injury or surgery. Stop an exercise if you feel pain, dizziness or shortness of breath. In an emergency, contact your local emergency services.
Programs, loads and nutrition targets are estimates built from what you tell us and what your devices record. Check them against how you feel. You are responsible for training within your limits.
AI features
Some features use an AI provider: coach replies, AI-built weekly programs and meal plans, food photo recognition and document reading. The app asks for your permission before the first one runs. If you say no, you can still train with a program built by our own rule-based planner.
AI output can be wrong or incomplete. We check training programs against our own safety rules, but no check catches everything. Do not rely on an AI reply for medical, allergy or injury decisions.
Free use and subscriptions
Training with Evolka is free. The AI coach, AI-built plans and nutrition features need a paid subscription. Any free trial, its length and the price are shown in the app before you start.
- Subscriptions are sold and billed by Apple (App Store) or Google (Google Play), under their terms.
- A subscription renews automatically at the end of each period unless you cancel it at least 24 hours before the period ends.
- Cancel in your Apple ID or Google Play subscription settings. Deleting the app or your Evolka account does not cancel it.
- Refunds are handled by Apple or Google under their refund rules. Your statutory rights as a consumer are not affected.
- If we change a price, the store tells you in advance and asks for your agreement where its rules require it.
Your content and ours
What you enter — answers, logs, messages, photos — stays yours. You give us permission to store and process it only to run Evolka for you, as the privacy policy describes.
The app, its exercise library, texts, images and the programs it builds belong to us or our licensors. You may use them for your own personal training. You may not copy, resell or redistribute them.
Acceptable use
Do not:
- Break the law or anyone else’s rights through Evolka
- Try to access other people’s accounts or data, or our systems beyond the app
- Reverse engineer, scrape or overload the service
- Use the AI features to produce harmful, unlawful or abusive content
Changes, availability and ending your use
We improve Evolka over time, so features can change. Pre-release builds can be unstable. We aim to keep the service available but cannot promise it will always be uninterrupted.
You can stop using Evolka at any time and delete your account in the app (Profile → Data & privacy → Delete my account). See how to delete your account. We may suspend or close an account that seriously breaks these terms. Where we can, we tell you first and explain why.
If we change these terms in a way that matters to you, we tell you in the app before the change applies.
Liability
Nothing in these terms limits liability that the law does not allow us to limit, including for death or personal injury caused by our negligence, or for fraud. Your mandatory consumer rights in your country are not affected.
Apart from that, we are not responsible for loss that was not reasonably foreseeable, or for loss caused by training against medical advice, ignoring pain or warnings, or relying on AI output for medical decisions.
General
Apple and Google are not parties to these terms and are not responsible for Evolka or its support. They are third-party beneficiaries only where their store rules require it.
These terms are governed by the law of England and Wales. If you live elsewhere as a consumer, you keep the protection of the mandatory law of your country and can bring a claim in your local courts.
A Turkish version is available: Kullanım Koşulları.
